Alina Habba has stepped down as the US Attorney for New Jersey. This decision was prompted by a legal ruling that questioned her right to hold the office.

Official Departure

The head of the Justice Department, Pam Bondi, accepted Habba's resignation on Monday. Bondi stated that the judicial decision made it "untenable" for her to lead the department effectively.

"But do not mistake compliance for surrender," Habba stated. "The effort will now extend throughout the country."

Court Ruling

Her resignation comes a week after a US appeals court ruled that she had been unlawfully serving as US attorney. This judgment is expected to impact scores of legal proceedings in the Garden State.

The judicial panel ruled that a acting appointment that skirted the advice and consent of the Senate violated the federal law governing appointments.

Future Role and Reaction

The Attorney General added that she will continue working within the DOJ as a senior adviser. Habba plans to seek further review of the court's action, aiming for a reversal.

In a statement, Bondi argued that the judiciary "cannot be permitted to countermand the executive's selection of attorneys tasked with carrying out the primary duty of the administration of prosecuting crime."

Record and Legacy

Bondi praised the prosecutor's work and said that during her run, the city of Newark saw a 20% reduction in criminal activity. It was also reported that the city of Camden experienced its initial homicide-free summer since 1974 without a homicide.

Background and Previous Role

The 41-year-old attorney, originally became part of Donald Trump's lawyers in 2021. She later defended Trump in his hush-money trial in the previous year, when he was conviction on 34 counts of falsifying business records.

Before her appointment to the federal prosecutor position, Trump had revealed he was selecting her as his presidential counsellor in a potential future term, describing her as a steadfast ally and a dedicated fighter for justice.
